He was wearing a basic Arkham inmate uniform. And the orange contrasting the darkness of the other characters would've made him stand it.

Back to the Bosses, they have pretty generic suits, the Harvey Dent mold could've been reused here for the suits if they needed to. Or even the Joker Thug or Scarecrow suits.

Figures of rehular guys in suits just don't sell well so we'll never see the mob bosses get made. We have not even got a Gordon yet!

First release could be a clean version.

Second release could be the torn outfit & include 2 heads, one with the mask & one without.
